These Terms of Service ("Terms") govern your access to and use of HSCodeLab (the "Service") operated by HSCodeLab ("we", "us"). By accessing the Service, creating an account, or using the API, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
HSCodeLab provides HS code search, AI-assisted classification, multi-country tariff calculation, policy alerts, and an API built on top of these capabilities.
The Service is a decision-support tool. All output is informational. Final classification and declaration are the responsibility of a licensed customs broker or the importer of record. We never replace and never claim to replace legal, tax, or customs advice.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By creating an account you confirm that you can lawfully enter into these Terms.
You are responsible for keeping your credentials secure and for all activity under your account. Notify us promptly at hello@hscodelab.com if you suspect unauthorized use.
3. Acceptable use
Do not use the Service to (a) violate any law or regulation, (b) attempt to circumvent rate limits, security, or access controls, (c) scrape or republish our data outside the rights granted by your plan, (d) input goods that are illegal to import or export in your jurisdiction with the intent of evading enforcement, or (e) reverse-engineer our models or pipelines.
We may suspend or terminate access if your usage is harmful to other customers, the Service, or third parties.
4. Subscriptions, billing, and refunds
Paid plans are billed monthly or annually in advance through our payment processor. Prices, included quotas, and overage rates for each plan are listed on the Pricing page and may change with at least 30 days' notice for active subscribers.
You may cancel at any time from your account settings. Cancellation stops future billing; we do not prorate refunds for the unused portion of the current period unless required by law.
Within 14 days of any first paid charge on your account, you may request a full refund by emailing hello@hscodelab.com. After 14 days the refund policy above applies.
5. Your data and content
You retain all rights in the product descriptions, photos, and other content you submit to the Service ("Your Content"). You grant us a limited license to process Your Content solely to provide the Service to you.
We do not use Your Content to train machine-learning models. Query records are deleted after 30 days unless you choose to save them. See the Privacy Policy for details.
6. Our intellectual property
The Service, including software, the aggregated tariff database, the classification models, the user interface, documentation, and the HSCodeLab name and logo, is owned by us or our licensors and is protected by intellectual property law.
Tariff data is compiled from authoritative government sources (USITC, EU TARIC, China Customs, UK Trade Tariff, Japan Customs, WCO, CBP CROSS, USTR). Underlying public data remains public; the curation, normalization, and translation layers are ours.
7. Reference-only disclaimer
AI classification results are based on benchmarks (current Top-3 accuracy ~92%) and may be incorrect. Tariff calculations depend on inputs you supply and on rules that change frequently.
You must independently verify any classification, duty rate, or compliance flag before relying on it for an actual import or export declaration. We are not liable for declaration errors, penalties, or seizures resulting from reliance on the Service.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED USD ($100), WHICHEVER IS GREATER.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA.
10. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate accounts that violate these Terms, with reasonable notice when practical.
On termination, your right to access the Service ends; provisions that by their nature should survive (IP, disclaimers, limitations of liability, governing law) will survive.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email to registered users and posted on this page with a new "Last updated" date. Continued use after the effective date constitutes acceptance.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws principles. Disputes will be resolved exclusively in the state or federal courts located in Delaware, except where prohibited by mandatory consumer law in your jurisdiction.
